3.1.6 Uganda: Access Pre-conditions and Requirements

The legislation in Uganda does not specify the nature of the person who can apply to access genetic resources. According to the wording of Rules 12(1), (7) and 14(4) & 10 and may be others, a natural person as well as a legal person may apply. According to the Fourth Schedule, amongst a host of information that has to be included in a material transfer agreement are the identity and curriculum vitae of the person leading the applicant’s access programme and profiles of institutions or individuals connected to the access programme. The rules are also not discriminatory on the nationality of the applicant. There is no requirement for a foreign applicant to have a local collaborator, or for a foreign applicant to pay fees different from a local applicant (Sixth Schedule).
